Annual leave offset

Dear HR Community

We have a staff whose last day supposed to be on 06/01/2022, but he will be using his annual leave (AL) to offset and bring forward the official last day.

And so he has informed us that his last day will be on 24/12/2021 since 25 December is a public holiday (PH).

Which means from 27/12/2021 to 06/01/2022 he will be offsetting his AL.

And since 31/12/2021 is replacement PH for 01/01/2022, do we count this as as PH or offset his AL as well?

We are a manufacturing company.

Replacement PH is paid working days, cannot use AL to offset. - Claudia

The replacement of Holiday should come in after the actual PH. In this scenario, the replacement should be on 3 Jan 22 or PH in-lieu. - HWW

According to MOM, "In accordance with the Employment Act, if a public holiday falls on a non-working day, you are entitled to another day off or one extra day's salary in lieu of the public holiday at the gross rate of pay." - AXL

I believe if the time of in lieu (for the 1st of Jan) for your company is pre-defined as 31st of December, the 31st should be counted as a PH for him/her. - Danielle

It would be PH - 31 Dec 2021 and AL - 1 Jan 2022 (I take it that both these days are scheduled working days). - BC

Since the employee last day is on 24 Dec, it means that all benefit ceased on 24 Dec including PH. - Jessica

Since his official last day of service is going to be before 31/12/2021, then he is not entitled to PH replacement as he is no longer your employee. - Yong

1) PH replacement should come after the PH 2) his official last day is 6 Jan 22, so rightfully he is entitled to claim that PH even though he is offsetting leave. Give that one PH replacement to him. - Lona
