Pre-Termination of Birth
QUESTION
Hi Fellow HR Friends
I would like to know if your company allow employee to claim compassionate leave for the pre-termination of a 22 weeks foetus which requires cremation.

A fetus is still considered a child to the parent? So long as the company’s policy indicates that compassionate leave can be taken in the event of death of an immediate family member such as mother, father, grand parents, grandparents in law, parents in law, brother, sisters, and brother in law, sister in law as well as children + children in law, then I guess it could be considered? The company could also practice empathy and consider as a good will to the employee if it falls out of the criteria of the compassionate leave.

This case can be treated as death of child So Compassionate Leave thereby applies.

Yes, it should. You know how difficult for the employee to go through this situation.

Yes we do allow compassionate leave of max 2 days in such cases.

It is already very hard on the mother, who is your employee, to face this situation; so the employer or HR person should be more sensitive and grant her compassionate leave, regardless of the P&Ps. Policies cannot cover every unique situation. And even if you set a precedent by doing so, a repeat of this condition will be rare.
