Recruiting Overseas Employee

Question

Dear HR Professionals,

Our company intend to recruit overseas employee. Example we are recruiting a Thailand candidate to base in Thailand in opening up market for our product. The question is if we get him to sign the letter of appointment under our Singapore company, do we need to get an employment pass for him here. He will be working 100% in Thailand and only report to our Spore office for 1 or 2 days for meeting.

You may need to see if his or her monthly payroll is under Singapore.

Is not required to hold any residence if the person permanent posted oversea.

You may have to take note and consider if is a full time employee, any local labor compliance such as the social security and insurance contribution etc, if your company do not have the entity register in Thailand, you are not able to make such arrangement.

My past experience we engage a outsources agent do all these contribution on behalf, employment contract will be signed by the employee and this outsource agency, they also will handle employee personal tax form (just like our IR8A) annually, your company will have to sign a service contract with them, of course.

This will make thing clear and you are covered by law for the employee entitled benefits by law in the respective location.
